GENERAL TERMS AND CONDITIONS

mvdham GmbH

12049 Berlin
Germany

Last updated: September 2026

1. Scope and General Provisions

1.1 These General Terms and Conditions (“Terms”) apply to contracts concluded between mvdham GmbH, Weisestr. 31, 12049 Berlin, Germany (“mvdham”, “we”, “us” or “Seller”) and its customers (“Customer” or “you”) for the purchase of goods offered by mvdham.

1.2 For orders placed through our online shop at mvdham.com, these Terms apply in the version valid at the time the order is placed.

1.3 Any conflicting or supplementary terms and conditions of the Customer shall not apply unless we have expressly agreed to them.

1.4 A “Consumer” within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

1.5 An “Entrepreneur” is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

1.6 Customers must be at least 18 years old to place an order.

1.7 Additional terms may apply to products offered for pre-order. Where applicable, the relevant Pre-Order Terms will be made available to the Customer before the order is placed.

2. Products

2.1 The subject matter of the contract is the sale and delivery of the goods offered by mvdham.

2.2 The essential characteristics of each product can be found in the respective product description.

2.3 We make reasonable efforts to display our products, including their colours and materials, as accurately as possible. However, the appearance of colours may vary depending on the device, screen settings, lighting and other technical factors.

2.4 Minor variations that are customary for the materials used or result from craftsmanship or production processes do not constitute a defect, provided they are reasonable and do not materially affect the agreed characteristics of the product.

3. Conclusion of the Contract

3.1 The presentation of products in our online shop does not constitute a legally binding offer to conclude a purchase contract. It constitutes an invitation to the Customer to submit an order.

3.2 The Customer may place selected products in the shopping cart and review or amend the selection before submitting the order.

3.3 Before submitting the order, the Customer is given the opportunity to review and correct the order details.

3.4 By clicking the button that clearly indicates that the order entails an obligation to pay, the Customer submits a binding offer to purchase the goods contained in the shopping cart.

3.5 After receipt of the order, mvdham will normally send an automated acknowledgement by email. Unless expressly stated otherwise, this acknowledgement merely confirms receipt of the order and does not constitute acceptance of the Customer’s offer.

3.6 The contract is concluded when mvdham accepts the order by expressly confirming acceptance or dispatch by email, or by dispatching the goods.

3.7 If mvdham does not accept the Customer’s offer within five days, the Customer will no longer be bound by the order. Any payments already received in relation to an order that is not accepted will be refunded without undue delay.

3.8 Order processing and communication relating to the contract generally take place by email. The Customer is responsible for providing a correct email address and ensuring that emails from mvdham can be received and are not blocked by spam filters or similar systems.

4. Prices and Shipping Costs

4.1 All prices displayed in our online shop are final prices and include applicable statutory value added tax (VAT), unless expressly stated otherwise.

4.2 Shipping costs are not included in the product price unless free shipping is expressly offered.

4.3 Any applicable shipping costs will be displayed separately before the Customer submits the order.

4.4 For deliveries to countries outside the European Union, additional customs duties, import taxes, fees or other charges may be imposed by the competent authorities. Such charges are not collected by mvdham and are the responsibility of the recipient where applicable.

4.5 Customers ordering delivery to a country outside the European Union are responsible for obtaining information about any applicable import regulations, customs duties and taxes.

5. Payment

5.1 The available payment methods are displayed during checkout.

5.2 Unless otherwise stated for a particular payment method or product, payment is due immediately upon conclusion of the contract.

5.3 Where payment services are provided by third-party payment providers, additional terms of the relevant payment provider may apply to the payment process.

6. Delivery

6.1 Goods will be delivered to the delivery address provided by the Customer during the ordering process.

6.2 The applicable delivery time is stated on the relevant product page or during checkout.

6.3 Different delivery times and conditions may apply to products offered for pre-order. These are governed by the applicable Pre-Order Terms and the information provided for the respective product.

6.4 If an ordered product is unexpectedly unavailable for reasons beyond our control, we will inform the Customer without undue delay. Where we are legally entitled to withdraw from the contract, any payment already received for the unavailable product will be refunded without undue delay.

6.5 For Consumers, the risk of accidental loss or accidental deterioration of the goods generally passes to the Consumer when the goods are delivered to the Consumer or to a third party designated by the Consumer who is not the carrier. Mandatory statutory provisions remain unaffected.

7. Retention of Title

The goods remain the property of mvdham until the purchase price and any applicable delivery charges have been paid in full.

8. Statutory Rights in the Event of Defects

8.1 The statutory provisions governing liability for defects apply.

8.2 Consumers are entitled to the statutory remedies available under applicable German sales law if the goods are defective or do not conform to the agreed characteristics.

8.3 Customers are encouraged to inspect goods after delivery for completeness, obvious defects and transport damage and to notify us promptly if they identify a problem.

8.4 A Consumer’s failure to make such a notification does not affect the Consumer’s statutory rights.

8.5 Any voluntary commercial guarantee offered by mvdham for a particular product applies in addition to and does not restrict the Customer’s statutory rights.

9. Liability

9.1 mvdham is liable without limitation:

  • in cases of intent or gross negligence;
  • for injury to life, body or health;
  • where mvdham has fraudulently concealed a defect;
  • where mvdham has expressly assumed a guarantee;
  • under the German Product Liability Act (Produkthaftungsgesetz); and
  • in any other case in which liability cannot legally be excluded or limited.

9.2 In cases of slight negligence involving the breach of an essential contractual obligation, mvdham’s liability is limited to foreseeable damage typical for this type of contract.

Essential contractual obligations are obligations whose performance is necessary for the proper execution of the contract and on whose fulfilment the Customer may regularly rely.

9.3 Subject to Section 9.1 and Section 9.2, liability for slightly negligent breaches of non-essential contractual obligations is excluded to the extent permitted by law.

9.4 Mandatory statutory rights and liability provisions remain unaffected.

10. Right of Withdrawal for Consumers

The following provisions apply to Consumers where a statutory right of withdrawal exists.

10.1 Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, acquired physical possession of the goods.

If you ordered several goods in a single order and they are delivered separately, the withdrawal period begins on the day on which you, or a third party designated by you who is not the carrier, acquired physical possession of the last item.

To exercise your right of withdrawal, you must inform:

mvdham GmbH
Weisestr. 31
12049 Berlin
Germany
Email: mail@mvdham.com

of your decision to withdraw from the contract by means of an unequivocal statement, for example by letter or email.

You may use the model withdrawal form provided below, but this is not mandatory.

For contracts concluded through our online shop, you may also use the electronic withdrawal function provided on our website where applicable.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of your right of withdrawal before the withdrawal period has expired.

10.2 Effects of Withdrawal

If you withdraw from the contract, we will reimburse all payments received from you in respect of the withdrawn contract, including the costs of the least expensive standard delivery method offered by us.

Additional delivery costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us will not be reimbursed.

We will make the reimbursement without undue delay and no later than fourteen days after the day on which we receive notice of your withdrawal.

Unless expressly agreed otherwise, we will use the same means of payment for the reimbursement that you used for the original transaction. You will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever occurs first, unless we have offered to collect the goods.

You must return the goods without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal.

The deadline is met if you dispatch the goods before the fourteen-day period has expired.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

10.3 Custom-Made and Personalised Products

The statutory right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and are made on the basis of an individual choice or decision by the Consumer, or to goods that are clearly tailored to the Consumer’s personal needs.

This may apply, in particular, to jackets or other products that are individually produced, altered or personalised for the Customer based on specifications selected by or individually agreed with the Customer.

The mere designation of a product as “custom”, “custom-made” or “personalised” does not in itself exclude the statutory right of withdrawal. The exclusion applies only where the relevant statutory requirements are met.

Where the exclusion applies to a particular order, the Customer will be informed accordingly.

The exclusion of the right of withdrawal does not affect the Customer’s statutory rights in the event of defects or where the delivered product does not conform to the agreed specifications.

10.4 Electronic Withdrawal Function

For contracts concluded through an online user interface for which a statutory right of withdrawal exists, mvdham provides an electronic withdrawal function in accordance with applicable law.

The withdrawal function is clearly labelled and is available and easily accessible on the relevant online user interface during the withdrawal period.

The function enables the Consumer to provide or confirm the information necessary to identify the Consumer and the contract, or the part of the contract, to be withdrawn.

The Consumer is not required to provide a reason for the withdrawal.

After the Consumer submits the withdrawal declaration through the electronic withdrawal function and activates the confirmation function, mvdham will provide an electronic acknowledgement of receipt on a durable medium without undue delay. The acknowledgement will contain the content of the withdrawal declaration and the date and time of its receipt.

The electronic withdrawal function is an additional means of exercising the statutory right of withdrawal. It does not prevent the Consumer from exercising the right of withdrawal by another legally permissible method.

11. Returns

11.1 Nothing in this Section limits the statutory right of withdrawal or the Customer’s statutory rights in respect of defective goods.

11.2 Where a Consumer exercises the statutory right of withdrawal, the rules set out in Section 10 apply.

11.3 In particular, the Customer bears the direct costs of returning goods following a statutory withdrawal, provided the Customer has been duly informed of this obligation.

11.4 A product being discounted or offered as part of a sale does not by itself exclude or restrict statutory Consumer rights.

11.5 Any voluntary return policy offered by mvdham in addition to statutory rights may be subject to separate conditions. Such a voluntary return policy does not restrict mandatory statutory rights.

12. Model Withdrawal Form

If you wish to withdraw from the contract, you may complete and return the following form. Use of this form is not mandatory.

13. Consumer Dispute Resolution

mvdham is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

14. Applicable Law

14.1 The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

14.2 If the Customer is a Consumer and has their habitual residence in another country, this choice of law does not deprive the Customer of the protection afforded by mandatory provisions of the law that would apply in the absence of this choice of law.

15. Place of Jurisdiction

If the Customer is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the courts at the registered office of mvdham shall have jurisdiction to the extent permitted by law.
